Messy Pods Terms and Conditions

  1. Messy Pods does not take responsibility for any loss or damages to personal possessions during any session.

  2. Parents/carers must not leave the building under any circumstances without taking their child/children with them.

  3. Messy Pods has zero tolerance on unacceptable behaviour (at session leaders discretion). Any attendee displaying such behaviour will be asked to leave.

  4. Messy Pods will not allow any child/adult to continue with the session if they are threatening the enjoyment or safety of other attendees. This includes using materials and equipment safely and not in a way to abuse or cause injury to other attendees.

  5. Messy Pods will not be liable for any stains or marks on children’s clothes. It is recommended children wear appropriate clothes for messy play.

  6. We do not keep any finished work from sessions, ensure you take your children’s work with you.

  7. Refunds are not available for non-attendance.

  8. Parents/carers are fully responsible for the safety and care for their child/children at all times.

  9. Parents/carers are solely responsible for ensuring their child/children do not come in contact with anything that may cause an allergic reaction.

  10. Messy Pods reserves the right to ask a child/adult to leave if they are unwell. Do not attend if you or your child are unwell.

  11. Messy Pods ensures the majority of materials supplied are toxic free, edible or hypoallergenic. However, we strongly advise materials are not to be consumed as some are potential choking hazards.

  12. Messy Pods does not accept any responsibility regarding any illness, allergic reaction, or accident linked or caused by any of the provided materials. Responsibility remains with the accompanying parent/carer.

  13. By booking with Messy Pods you automatically agree to sanitizing your hands and allowing your temperature to be taken upon arrival.

Confidentiality Policy

In order to ensure that Messy Pods is compliant with the GDPR, it is essential that Messy Pods inform parents/carers of how we keep your personal information.

When your child attends one of our classes it is essential that Messy Pods obtain the necessary data requested.

 

Confidentiality Procedure

  • Messy Pods will ensure that any information gained from parents/carers is kept completely confidential. This includes written and verbal data. Both your data and your child’s data will be kept confidential and will only be shared with your consent. Messy Pods have devised various forms for parents to fill in so that you are fully aware of how we may share data, again your consent will be gained. The only exception where Messy Pods may be unable to share specific data with you is in the case of a child protection breach, in this case, Messy Pods is legally obliged to share with the relevant authorities to ensure that welfare and safety of the child is protected.

 

  • In the event that Messy Pods would need to share sensitive data with parents and carers, such meetings will be taken in private in order to protect the privacy of yourself and your child. Messy Pods will never share sensitive data with anyone unless we feels a chid is at risk of harm or emotional abuse.

 

  • Only parents/carers (those with parental responsibility) may be given access to their child’s data. Under no circumstances will data be released to anyone than those with parental responsibilities.

 

  • When a child leaves our classes, Messy Pods will keep a certain amount of data on your child. You can request that Messy Pods destroy that data in accordance with the right of erasure.

 

  • All photographs and data that Messy Pods hold on your child will be stored on a password encrypted computer. Messy Pods will always seek parental permission if wishing to use photographs for marketing purposes and this includes the use of photographic data on Messy Pods website or social media platform page. Parents have the explicit right not to consent and to withdraw consent at anytime.

 

  • Messy Pods will keep all your child’s personal data in a securely locked file. Messy Pods are the only ones who will access to this. Information will be made available to parents on request.

 

  • Any photographic information or data that is saved on any mobile devices including iPad, tablet, and phone are password encrypted or finger print password protected. This also includes photographs/data that are stored in the cloud.

Your data will be kept safe as will any sensitive information that you provide to Messy Pods regarding your child or your own life.

Changes to our Confidentiality Policy

We review our Confidentiality Policy on a frequent basis to check that it accurately reflects how we deal with your information and may amend it if necessary. You should check this page regularly to see the most up to date information.

Privacy Policy 

In line with the GDPR, Messy Pods has a duty to operate in line with the requirements of the GDPR. We process personal data relating to those that attend our services, in accordance with Article 6 –“ the rights of data subjects’ under Data Protection Act 1998.
(‘Processing of special categories of personal data’ under the GDPR – from May 2018.)

Information we will gather about you:

  • name 

  • address

  • consent regarding photographs

  • information used for booking (e.g child’s age)

  • payment details

Occasionally Messy Pods will ask you to update your data, this is to ensure the information we hold about you is up to date.

Storing of Personal Data and Retention Policy

  • Your data will be stored in a locked cabinet or password encrypted device

  • Messy Pods will keep your data for a specific period of time as we are legally obliged to do so. 

  • Booking forms; Name of parent/carer/child/children, date of birth of child/children and contact of customer home address, telephone details, email address, allergies and photograph permission. 

  • These are kept for legitimate interested and will be retained for up to 6 months from last contact or unsubscribed received.

 

Online Data Processing 

The data that Messy Pods collect from your child and family will be stored on laptop computer/I pad.

 

Website

If parents visit the Messy Pods website we do not collect any specific information. We provide numbers and email addresses for potential parents to contact Messy Pods Google analytics collects details on visitor behaviour, but Messy Pods do not in any way use.

 

Paper Data

Any documents that are not needed or wanted by the parents and are not required to be kept for a minimum amount of years will be shredded or burned. Please see the settings Retention Policy for further information.

The types of the paper process I am likely to process is as follows:

  • Children Information Records; Lockable cabinet, securely locked (or online system that is password encrypted

  • Video Footage; iPad/Computer/Mobile Phone, password protected and fingerprint password

  • Photographs; iPad/Computer/Mobile Phone, password protected and fingerprint password

 

All of the above information is stored in order to maintain confidentiality and respect your privacy. It also protects against possible data breaches by preventing access to those who do not require access to your data. Messy Pods is committed to ensuring that your data is fully protected and is not shared with anyone other than the data subject or relevant authority.

 

The Right to Request Access to Your Personal Information

Under GDPR and UK Data Protection law you, the data subject has strong data protection rights, and this means that you have the right to request access to your data. It also means that you have the right to have your data modified immediately if it is inaccurate.

You can also ask for your data to be erased, though please note this can be done in most cases unless there is a lawful reason for us to do so

Covid-19 Policy

COVID-19 Policy

If you or someone in your household is unwell with symptoms of coronavirus (a

new continuous cough or sudden loss or change of sense of taste or smell, or a sudden high fever) or if you or someone in your house has been in contact with someone who has tested positive for COVID-19. You should not attend any of our sessions, until a negative COVID test or the end of the isolation period.

 

Parents are required to keep us updated in regards to the health of themselves and their household.

 

Parents (unless exempt) must wear a secure face covering which which safely covers the nose and mouth can help reduce the spread of coronavirus. Transparent face coverings can be used to assist communication where people rely on visual cues such as lip reading

     

At Messy Pods we will ensure all materials are cleaned and/or replaced before the setting opens to children and at the end of the day

 

Regular, twice-weekly testing of adults can detect asymptomatic cases and help stop the spread of the virus. Participation in testing is not mandatory but is strongly encouraged
